Folks often ask: Can my social security disability benefits be garnished?
The answer is a qualified NO.
Generally garnishment of disability benefits is not allowed. However there are a number of exceptions and the answer also depends on whether the person is receiving SSI or SSD benefits.
The feds can garnish SSD benefits to recover back taxes and student loans. SSD benefits can also be garnished for child support. Sometimes others try to garnish from bank accounts but federal law requires banks to review accounts before garnishing to see whether funds in the account are from disability benefits.
